Yeah, we all up for a bit of fun, no-one expects to be making money from these remixes we post (although it would be nice to feature on a Beastie single though wouldn't it? :D ) and I think if we ain't claiming a dollar for our mixes then we should be cool.
I think it can be cool to pick out a nice riff, chord, note, vocal sample and inject it into a mix... but I think it needs to be executed with a bit of creativity, put your own personal spin on things. Simply matching up some looped/sliced riffs with some accapella ain't being too creative.... although I'll admit it can be nice to hear a mash-up or two when your out in a club or something getting oiled. ;)

Dear Mr. Martin:

I write on behalf of EMI Music North America and its affiliate labels
Capitol Records and Priority Records ("EMI"). It has come to our attention
that Steven Rush is currently exploiting sound recordings that are owned
and/or controlled by EMI. In particular, it appears that Mr. Rush is using,
without authorization, on his website, http://www.funky49.com/music.html and
http://www.funky49.com/June14_Buy_ForThe5Boroughs/, (collectively the
"Website"), copies of sound recordings embodying performances of the Beastie
Boys, NWA, and possibly other EMI recording artists (the "Artists"),
including but not limited to recordings of "Root Down," "Shake Your Rump,"
"So Watcha Want," "Alive," "Pass The Mic," "Ch-Check It Out," and "Dopeman"
(the "EMI Recordings").

Steven Rush's unauthorized exploitation of the EMI Recordings constitutes
copyright infringement, and renders Steven Rush, and any other company
engaged in the unauthorized exploitation of the EMI Recordings with Steven
Rush, liable for all of the remedies provided by the relevant laws
occasioned by Steven Rush's unfair competition and dilution of our valuable
property.

I am the agent authorized to act on behalf of EMI, the complaining party. It
is our understanding that Pair Networks, Inc. is the Internet Service
Provider for Steven Rush and the Website, and as such, you are the
authorized agent for service of this notice in accord with The Digital
Millennium Copyright Act of 1998, 17 U.S.C. § 512 et seq. (the "DMCA
Notice") for Pair Network, Inc.

We request that following your investigation of this matter you provide us
full remedy under the DMCA Notice requirement, including but not limited to,
expeditiously removing or disabling access to our copyrighted material.
Unless we receive full and immediate compliance with this demand within a
reasonable amount of time, we will be forced to consider pursuing our other
remedies at law and in equity.

It should only affect those that make money off it. It happened to DJ Danger Mouse when we mixed Jay Z's the Black album with the Beatles White album for the Gray album. He couldn't sell it so it was put up for download. It would be pretty sad if they start targeting people off a message board that ain't making a single buck off it. I think they'll first get people like Green Lantern who is selling their shit. But for now, all they're trying to do is scare you. People are still going to do it no matter what, like those people who speed up when the light turns yellow.

Thats right, the people making these laws dont know what creativity is, Pauls boutique is one of the greatest records of all time in my opinion, chalked full of samples. It is human nature to take something you hear, smell, touch, see whatever and try to use it to create something better or different, i.e.sample it.
Another example of music defeating itself. The old guard doesn't get the new stuff so they attack it, when in fact NWA is paying respect to George Clinton and increasing awareness of Funkidelic with a younger generation that would otherwise never think of George Clinton. Who ever invented a specific cemical mix to make a specific color of paint doesn't "own" that color of paint. Pretty soon the guitar companies will want money for the sound of their guitars

It sux. How'd the Avalanches release their 2001 album its apparantly completely made up of hundreds of samples, yet it was a big hit, at least in Europe & Australia. They must have spent ages getting them all cleared. So I guess it can be done.
