Court spares killer over jury's use of Bible

Condemned man gets life in prison for killing waitress

DENVER - The Colorado Supreme Court threw out the death sentence Monday of a man convicted of raping and killing a cocktail waitress because jurors consulted the Bible during deliberations.

advertisementThe court said Bible passages, including the verse that commands “an eye for an eye, a tooth for a tooth,” could lead jurors to vote for death.

The justices ordered Robert Harlan to serve life in prison without parole for the 1994 slaying of Rhonda Maloney.

Harlan’s attorneys challenged the sentence after discovering five jurors had looked up Bible verses, copied some of them down and then talked about them behind closed doors.

Prosecutors said jurors should be allowed to refer to the Bible or other religious texts during deliberations.

not even sure how i feel about this......

i hate the idea of jurors using the bible to think for them.....but is it grounds for a possible miss-trial or appeal?

It is grounds for a mistrial, as would be the jurors merely being influenced by the bible in any way shape or form. Juries are required to find in a case based on *the law* and *the case made*. They are not allowed to roll dice, flip coins, or consult a book which has no legal authority on the matter.

They are not allowed to roll dice, flip coins, or consult a book which has no legal authority on the matter.I agree although it would be hard to find a jury outside of the republic of Boulder that would not be influenced by the bible, I'm surprised they had to look it up, and did not know it by heart.Colorado is serious bible thumping territory.
