There's a very important copyright case involving the Beastie Boys and James Newton. The Beastie Boys won their case at trial and on appeal. They paid Newton's record label for the license to sample Newton's recording, but did not pay Newton for the license to sample the underlying composition. The court found that the sample was too short and basic to constitute sufficiently original material, and thus could no be protected by copyright laws. I believe the name of the case is Newton v. Diamond.
