Judge tells off 'smart arse' bomb hoaxer

A QUEENSLAND judge has warned a man guilty of a bomb hoax not to be a "smart arse".

Dominic Arthur Burns, 21, of Brisbane, today pleaded guilty in the Brisbane District Court to a bomb hoax he committed against a recruitment agency on September 16, 2005.

Prosecution lawyer Carole Marco told the court Burns phoned Adecco, based in Eagle Farm on Brisbane's northside, and told a female employee there was a bomb in the building.

"(He said) 'There is a bomb in your building, no seriously, there is a bomb in your building and you had better get out'," Ms Marco said.

Burns used an American accent when making the call.

Ms Marco said the police were called in, sparking an evacuation of 15 people from the building, which also housed three other businesses.

The police didn't find anything suspicious but eventually traced the call to Burns' house six months after the incident.

Ms Marco said Burns had admitted to police he made the call.

However, he said he had requested an interview with the agency that day and, when told there was no need for him to come in to the office, he responded: "It's not as if I'm going to blow up the building."

Judge Nick Samios said he was not convinced by Burns' story that the call was made in a "light-hearted manner".

He warned Burns, who is unemployed and living with his parents, not to continue acting foolishly.

"If you're a smart arse about it .... you will be caught down the track," Mr Samios said.

"You'll get the biggest whack in the backside you've ever had.

"You don't look like the kind of person that would do well in jail."

He imposed a two-year probation on Burns, who also agreed to carry out 200 hours of community service.

Mr Samios also ordered Burns to undergo an impulse control program due to a psychological report's finding he had "impulse problems" and was "compulsive".



i used to be pretty good friends with this guy. we did used to have some pretty good times together, and we did do some incredibly stupid shit too. one time i got in trouble from the police because of an alleged death threat he made from my phone to my mechanic. i couldn't help but laugh when i read this article. "It's not as if I'm going to blow up the building." this sounds exactly like something he'd say, lol

i have a client charged with something like this, only it was Wal-Mart and it was 4 calls w/in a week. i also have someone who had a realistic looking grenade and pulled the pin out, and while the waitress where he was at was begging him to put the pin in, he pulled out another grenade and pulled the pin out of it, too. stupid fucks.

then i have this other kid that was trying to kill himself and the neighbors tried to prevent it. instead of sending the crisis intervention team, they sent out a regular cop who tried to bust into his house. when he tried to protect himself from that cop, swat was called in. swat shot him in the neck.

Hilarious. we used to make prank phone calls to the operator and pretnding to be a kid being held hostage and having the kidnapper yell into the tphone and hang up. They would send cops down all the time. We almost got caught once though.

depends on their record, really, and whether the state is going to be willing to downward depart off of any minimum mandatory score.

possession of hoax bomb is a felony of the 2nd degree, level 7, punishable by up to 15 years in prison and/or up to $10,000 fine. he has 2 counts. his scoresheet will score one as the primary offense, for 56 points, and one as a secondary offense, for 28 points. this totals 84 points. the formula is points -28 x .75 = months. you only figure the points if they're over 44, because that means the person scores a minimum mandatory prison term, and to go lower would require a downward departure. so, this guy, even if he has no prior charges ever, scores a minimum mandatory 42 months, or 3 and a half years, state prison. me faces a maximum 30 years and/or $20,000 since there are 2 counts that could be run consecutive.

the other guy who made the bomb threats is a little luckier. it's a 2nd degree felony, but it's only a level 5, and at this time they can only prove 3 counts. so the first one has an offense level of 28, and the other two will each count as 5.4 points for additional offenses. so, with only 38.8 points, he doesn't score mandatory time. but if he has a lot of priors on his record, like 5.2 points worth, he will then score mandatory time. he faces a total of 45 years and/or $30,000 fine. just because someone doesn't score mandatory time does not necessarily mean the prosecutor is going to offer them something less than state prison. they can offer whatever they want, and the judge can sentence them all the way up to the max.

Same thing was just happening here. He got off "easy" at 300 hrs community service + 6000€ fine. But I hated how the judges wanted to make this look like a real thread. There is nothing to be afraid of if someones thread has been debunked, but everybody is still like "Danger Will Robinson". (n)
