City cop caught on video beating woman bartender
Tactical officer cited in aggravated battery

While Officer Anthony Abbate was pummeling the petite bartender with his fists and feet in an attack caught on video, she said, he kept shouting, "Nobody tells me what to do."
Karolina Obrycka, who suffered head, arm and rib injuries, had cut him off because he was drunk, fighting with other patrons and trying to buy rounds of shots without any money, she told investigators.
After the Feb. 19 beating at a Northwest Side bar, someone came into the bar before last call and offered her money to forget about the attack, Cook County prosecutors said Wednesday in court.
Prosecutors charged Abbate, 38, a tactical officer, with felony aggravated battery late Tuesday, a week after Chicago police officials had quietly filed a misdemeanor battery charge on March 14.
Sources familiar with the investigation said police had pre-emptively charged Abbate before the Cook County state's attorney's office had completed its investigation, and prosecutors took steps to upgrade the misdemeanor charge after they learned about it Monday.
Prosecutors are looking into whether multiple police officers threatened to arrest the victim and bar owner on trumped up charges if they didn't drop the case, sources said.
John Gorman, a spokesman for the state's attorney's office, said: "At the time of the arrest for [misdemeanor] battery, there was a lack of communication between Chicago police and the state's attorney's office. After the tape and the case [were] reviewed by our supervisors, it was decided this week to upgrade the case to [felony] aggravated battery."
When asked whether prosecutors learned of the lesser charge filed by police only on Monday, Gorman declined to comment.
But Terry Ekl, Obrycka's lawyer, said, "That's got a stench to it, the way the cops handled that part of it."
Chicago police spokeswoman Monique Bond said Wednesday that prosecutors were aware of the misdemeanor charges and that they had agreed with police that the beating itself was only misdemeanor battery.
"Thousands of cases a year occur when a simple battery under similar circumstances are not upgraded to aggravated battery when the offense occurs in a public place of accommodation or amusement," Bond said.
"The department was outraged by this incident upon viewing the video and moved quickly to remove this officer from the street," said Bond, who added that the department will move to fire Abbate, a 12-year veteran.
Gorman disputed that prosecutors were on board with the lesser charge.
"There never was an agreement on the part of our office that this should be charged as a misdemeanor case," Gorman said.
On Wednesday, Criminal Court Judge Raymond Myles set Abbate's bond at $70,000. Abbate appeared at the hearing over closed-circuit television.
The incident happened about 11:30 p.m. Feb. 19 at Jesse's Short Stop Inn, 5425 W. Belmont Ave., while the officer was off-duty. The video shows a large man shoving a much smaller woman to the floor and repeatedly punching her.
Assistant State's Atty. David Navarro said Abbate became louder and more obnoxious as the evening wore on and had earlier attacked another patron.
"It was one of the most brutal and savage attacks I have seen on tape," Navarro said after the hearing. "The bartender weighs all of 115 pounds and was beaten by an off-duty duty officer double her weight."
Abbate's attorney, William Fahy, said his client, who has been working as a tactical officer in the Lincoln District, had completed an in-patient substance-abuse treatment program on March 5 but has never been disciplined or suspended since he joined the department in December 1994..

I actually knocked a guy out at a gas station because he was smacking his girlfriend/wife.
I don't really understand why people just stood there. Maybe they knew he was a cop and had a gun.
