I'm wondering if anyone can answer my question...

lets say you are a marine and you're out on leave and you oh say...punch someone in the neck and kill them...do you get dishornoably discharged?

really sad situation happened to a friend of a friend this weekend. 3 guys...who later turn out to be marines were harrasing a woman at a campground on sunday night. My friends friend (a dude) told the three guys to knock it off. 3 guys get mad and leave...only to come back a short time later to fight and one of them punches dude defending woman in the neck, colapsing his larynx and causing him to choke to death before the paramedics arrive.

in my opinion the judge should throw the book at these "soliders". (I hesitate to call them that because I don't think such scum should be representative of all the good men and women who are fighting for us.) Doesn't thier military training more orr less make them lethal weapons? Second, because of thier military training wouldn't they have know that that they threw a potentially lethal punch? (could it constitute premeditated murder? that and the fact that they left and came back to inflict damage?)

I hope the judge throws the book at these guys and that they are discharged from thier military service. The guy that died did nothing more than defend a woman that was being harrased by these men. it's disgusting and they deserve the worst that could possibly happen to them.:mad:

Firstly, please don't confuse "marines" with "soldiers". We both hate being mixed up like that(y)

The guy just fucked himself. He can't say that he did it in defense. He can also be charged on both the military and civilian side. He's probably received his cout martial already and in the brig.

If they want to push it, he could get charged with some kind of aggravated sexual charge and with a murder charge on top? He's probably looking at 2 life sentences.

And of course, a big fat healthy dishonorable discharge for the stupid jarhead who did nothing but take advantage of his training and using it against a person that he's supposed to defend with that same training.

You get double punishment when you do stupid shit and are a soldier/marine. And you should. Military personel have a responsibilty to themselves and thier peers to keep thier head out of water, in the civilain world and military world. The other two idiots should get the book thrown at them too because they had the responsibility to keep thier friend out of trouble.

it would depend on the state law, but it could potentially be murder. he probably wasn't intending to kill the guy by punching him, but there's ways to make it murder. there's felony murder, which varies from state to state, but if he's engaged in a felony that's extremely dangerous to human life (is punching a guy in the throat a felony? i'd hope so) it can make any deaths resulting from the act murder. or it could be extremely reckless murder.

i dunno, it's only been like 2 weeks since my criminal law final, i'm getting flashbacks. beth would know more, but yeah i mean, it would at least be manslaughter.

that's really fucked up. they should crush his head in a vice slowly, maybe one turn of each screw a month till he leaks into a coma.

if i were defending him, i'd argue for an aggravated battery (best case outcome) or manslaughter.

one of my big pet peeves is when someone says "i hope the judge throws the book at him/her." it's just a ridiculous statement to me, that has been perpetuated over time. you don't really want the judge to be throwing a book, you want the guy to get the maximum for the highest penalty possible. i know, i'm nit-picking, but that's what pet peeves are about.

and it's their, not thier. sorry, i had to.

They made a movie allllll about this very subject,it's called "Con-Air".....a heart rendering drama of sweeping scale a nd proportion,an emotionally introspective look at the consequences of applying lethal force otside the parameters of a combat situation.....and the peril of deploying said skills that,one has ascertained in the the pursuit of military service,against irreputable foes,outside a bar,late at night,defending the honor and well being of your spouse..... Nicholas Cage will take your breath away....I think it won top prize at Cannes the year of it's release.....more coffee please.....:)

I don't think I could ever be a defender....I'd have to be a prosecuter.

being a layman, I never thought much about the reality of what throwing the book would mean...sort of just a saying I've heard so many times I just started using it. but yeah....I get why it bugs you. it's kinda like when I hear people say..."oh she had botox injected in her lips."...cause you can't inject botox in someones lips...unless you want them to look like they've had a stroke and drooooool all over.

Exactamundo....that whole double jeopardy thing doesn't apply to military folks...you can be punished on the civilian side and the military side for the same thing. I hope this douche gets his

That was the best story eva written. Didn't he fall from the plane and the friction was so intense that he caught on fire and landed on a motorcycle and drove and the cops were chasing him to get him back on the plane and he dropped a bag of diapers and he had to turn around to snatch them and then he actually did turn into a cop in 60 seconds and then had a big building collapse on him only to survive later just to realize he hates his life and moves to Las Vegas just to have raunchy sex with a hooker and drink himself into eternity?
