Hello Nasty was already in an iPod ad. It's not like they're using the music to sell the product, they threw in a bunch of albums and The Mix Up is one of them. If anything it's probably in the deal they signed to get their music on iTunes that their name/artwork/etc. can be shown in Apple ads.

yea, I doubt that they signed off on that or that they are getting paid from this spot, which features a 1 second close-up of the album on an ipod/applephone...

ipod uses a catalog of hundreds of albums to advertise their products...if its on itunes, it is fair game to advertise for the ipod...
