David Bain. I followed this case daily when I was doing a paper-run back in 1994-95. I don't know that I'd call him innocent, like people on TV3 News seem to be (cheers Youtube). Sadly, the only media I'm exposed to is pretty sycophantic, and seems to paint him as a man wronged.

One of my friends' Mums is a Judge in the North Island, and popular (although informal) legal view at the time had him guilty as all fuckery. Evidently there was no way to defend him initially, with what was involved in the prosecution case.

For those wondering, in 1994 David Bain (then 22) comes home from a paper-run at 6:45 in the morning, finds his two sisters, mother and younger brother all murdered in their bedrooms via .22 rifle. His father is found in the lounge with a point-blank gunshot wound to the head. A message on the nearby computer says "Sorry, you were the only one who deserved to stay".

A Jury found that Bain murdered 4 of the family members before going on his paper-run, coming home in time to then shoot his father from behind a curtain, as he knelt for his morning prayer. After being convicted in 95, Bain's supporters (namely a famously alcoholic and professionally disgraced Joe Karam) have taken his case to every court of appeal in the land. His case was the last New Zealand case to be heard by the Privy council, who subsequently quashed the convictions, citing a "substantial miscarriage of justice" that "has actually occurred". Now awaiting a decision on whether to retry, Bain is largely treated as innocent.

It's said to be unlikely they'll retry him, as the evidence is all fucked now, along with witness' recollections of evidence.

The boss of TVNZ got in the shit for suggesting to Parliament that Police 10 7 met media obligations to Maori content in New Zealand broadcasting, because most of the crims are Maori.

I haven't really followed developments closely enough to form a decent opinion, but the tv tells me he is a nice guy and that he didn't do it, and who am I to question television.

Gareth will probably know something more since he is a baby killing lawyer.

he is treated as innocent but the courts never said he is actually innocent.
people just treat him that way because of the whole "miscarriage of justice" thing and because by the time the whole thing went to the privy council, he had already served the bulk of his sentence.
also, there was evidence before the privy council that wasn't before the court of appeal here [i think the main bits were that father bain was having an incestual affair with his daughter/d.bain's sister and people in the community had found out, thus leaving father bain in a fragile mental state...and perhaps liable to snap and go on a murderous rampage]
basically i guess, it is not beyond reasonable doubt that david bain committed the crimes that he was locked up for, but hasnt he been pardoned or anything...
also, you were a paperboy when he was.

I remember being 14 and thinking "Man, if they want to suss out whether or not he killed his family, check how many Missed Deliveries were on his Run that morning, to see if he was distracted at all".

I knew people who went to school with Steven Bain. I also had a copy of Joe Karam's first book, which alleged that Laniet had aborted her father's baby.

I suppose so. All it makes me do is wonder why he bothered.

Not that he shouldn't have, but rather why he saw this as a worthy cause.
