So if I was at a party with alcohol being served and there were people under 21 (legal drinking age in Virginia) and the cops came, could I get in trouble? Even though the person hosting the party was over 21.
And I didn't provide the booze.

No. I'm not hosting, just an attendee.
A friend of mine has people over and invites me over all the time but I am always reluctant to go because his brother and his brother's friends are there and they are all underage and I am not sure if I can get in trouble if they are drinking.

you mean you've actually been in a situation where a part was busted over underage drinking? you're actually worried?
I am not worried about the cops coming because of underage drinking. I'm wondering what would happen if they came because of a noise complaint or something like that, and then when they arrive there are underage people hitting the sauce. Would me and the other people of age be charged with deliquency of a minor or some shit?

i don't think they would give a shit. they'd just come and tell you to shut up then leave. if they had to come back then maybe they would do something.
I don't think you would get into trouble. I know here you would not unless you were suppling or hosting.
My friends were at a party that was busted last week for a noise complaint. The host was a minor and most people there were minors besides maybe 5 people. The host was fucked and the minors got MIP's. The others got off.

Not true. I am in Richmond Va. A man and woman had a party and let their High School kid invite friends. They were busted and are facing 5 years in jail. It is a big story because it sounds like they will get the jail time.

thats a totally different story. they were all under aged there. and the parents let their kids drink there. you are not the parent of a kid at that party, nor do you own the house, nor are you supplying them alcohol. you are just hanging out. you even have the whole "heeey i didnt even know they were under 21" thing going for you.

i do believe you can be fined even though you were not the host i think they ticket everyone 21 and over at a party in which there are people that are not of drinking age just run out the back to or something to avoid all cops though is my advice on this topic

I think you may be alble to technically get in trouble for it but I doubt you would...I think that depends on the circumstances though. Like say it's a bunch of 16 year old high school kids and you're the only legal one you would probably be fucked but if it's a party with a few 19 or 20 year old and multiple 21+ people I think you're fine....

your friend would get in trouble, you wouldnt. those providing the alcohol and/or the guardian of the underage individuals get in trouble, as well as the person whose house the drinking is taking place in. but other party goers are fine, as long as they're not the only person over 21 in the place.

I kinda think that we need to lower the drinking age of beer and wine to about 13 and raise the driving age to 18.

§ 4.1-306. Purchasing alcoholic beverages for one to whom they may not be sold; penalty; forfeiture.
A. Any person who purchases alcoholic beverages for another person, and at the time of such purchase knows or has reason to believe that the person for whom the alcoholic beverage was purchased was (i) interdicted, or (ii) intoxicated, is guilty of a Class 1 misdemeanor.
A1. Any person who purchases for, or otherwise gives, provides, or assists in the provision of alcoholic beverages to another person, knowing that such person was less than 21 years of age, except (i) pursuant to subdivisions 1 through 7 of § 4.1-200; (ii) where possession of the alcoholic beverages by a person less than 21 years of age is due to such person's making a delivery of alcoholic beverages in pursuance of his employment or an order of his parent; or (iii) by any state, federal, or local law-enforcement officer when possession of an alcoholic beverage is necessary in the performance of his duties, is guilty of a Class 1 misdemeanor.
B. In addition to any other penalty authorized by law, any person found guilty of a violation of this section shall have his license to operate a motor vehicle suspended for a period of not more than one year. The court, in its discretion, may authorize any person convicted of a violation of this section the use of a restricted permit to operate a motor vehicle in accordance with the provisions of subsection D of § 16.1-278.9 or subsection E of § 18.2-271.1.
C. Any alcoholic beverages purchased in violation of this section shall be deemed contraband and forfeited to the Commonwealth in accordance with § 4.1-338.

Any person, not being married, who voluntarily shall have sexual intercourse with any other person, shall be guilty of fornication, punishable as a Class 4 misdemeanor.

I hear that many cities are coming up with ordinances that are more strict than the state statutes. Even some of our smaller suburbs are cracking down on people who provide alcohol to minors, but I haven't seen one yet that made it a crime to be at the party.
If you don't go to the party, you don't have to worry about whether someone will later accuse you of having indirectly contributed to the keg or whatnot.

this happened to some of my friends. there were minors drinking and plenty of people over 21 that hadn't supplied the alcohol but were just hanging out. everyone over 21 got fined.
