I would say the real story is the B Boys are getting penalized by EMI for not making the HSC Pt1 deadline despite MCA's health issues. And they could be penalized for not making Pt2. So given they don't have the tracks ready for Pt 2, they put the Pt1 tracks into Pt2 to make their obligation for the Pt2 release date. It may not have said in their contract 'what tracks' that will be included in Pt2.

i dont think that record company penalties (whatever they are) would be a factor at all. I would imagine the band are just thankful to still be working together
