Well calling cell-phones I don't see changing anything other than more folks just screening their calls. I've had debts before and I knew when I could pay em off and so usually I ignore it and pay it off on my terms. I can't deal with a snotty ass person on the other end pretending to know my situation. I mean I know they are only doing their jobs. It can't be easy.
YOu know I voted for Obama but I am starting to get confused by his tactics lately. The other side is saying he's doing certain things to get his ratings up because so many of those who originally supported him have stopped. I was listening to Laura Ingraham and she said Michelle Obama sent out email invites to supporters that for $3.00 donation they could win a dinner date with Obama so they can get a chance to talk to him about what they wanted to see to see changed in our economy. She said the fact that it was so cheap to be able to spend time with him is a red flag about the numbers of support he's losing.
I know this sounds stupid because stabelizing America is much more important, but I was devestated when he took away Nasa. I hope it was worth the sacrifice and that money really is going to be used to help the U.S. :rolleyes:

so, do you take a similar approach to people that owe you money? i guess living up to the terms of a loan agreement really doesnt matter....
this puts fox news in the awkward position of having to choose between sympathizing with obama or debtors (filthy student debtors no less). how will they deal with it? probably by not thinking too hard about it

actually i agree with obama. the FDCPA was passed when there was no such thing as cell phones. now, people have cut their landlines and some families on have cell lines. its just bringing the FDCPA up to date with technology. however, collecting of govt debt is a bit different than private debt. as with most issues, the govt doesnt follow the same rules that it requires everybody else to follow.

How do you feel about FDCPA actions based upon warningless interrogatories in civil litigation?

The only reason I am knowledgeable about the FDCPA is that I did work for the 3rd party collection agency for a brief time when I graduated college in the early 90s, a time between jobs. It was a job that absolutely sucked, but it did pay with good benefits, and I met 2 other guys in similar circumstances with whom I have remained extremely good friends with. It was mainly credit card and consumer debt.
The FDCPA is just there to protect the consumer. What times can you be called, how, what can be done to skip trace, etc. Anybody with a lick of sense can look up the law and read what tools the debtor has to protect themself from harassment and abuse. And there are some shady companies out there. That being said, putting an agency on notice about phones calls, communication etc still will not stop legal action against you. Pay your bills or work with your creditors and you can avoid it all. Or avoid being in debt in the first place. The only thing I can recommend if you are in debt is to try and work with the original creditor, document everything, keep good records, and be courteous.
Keep in mind too that the FDCPA only applies to 3rd party collection agencies, not the original creditor. If you owe $1,000 to ABC Bank for a car loan, they can technically call you whenever and where ever.

No I pay my debts, I just don't like being harrassed! And if they are going to call they should it least know about each person's account. I can't tell you how many times they call and not know somethings already been worked out. Usually they have NO clue.

He asked how would you like it if people who owed you money paid you back "on their own terms"
